TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of the ascubadiving website at ascubadiving.com (the “Site”) and any products, courses, trips, or services purchased from ascubadiving (“we,” “us,” or “our”).

By using the Site or our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

2. Eligibility

You must be at least 18 years old to make purchases or book services on the Site without parental involvement. Minors may participate in courses with parental or legal guardian consent and required PADI Junior course paperwork, completed in person at our shop.

 

3. Products and Services

We offer:

  • PADI scuba courses (Discover Scuba through Divemaster, and specialty courses)

  • Technical and rebreather training

  • Equipment sales (new and used)

  • Equipment service through our partner Airtech Scuba Services

  • Air fills for certified divers

  • Dive trip planning and group trips (including through our partner Ocean First)

  • Custom dive travel

Service availability, pricing, and details may change without notice. We reserve the right to refuse service to anyone at our discretion, including for safety reasons.

 

4. Pricing and Payment

Pricing

Prices listed on the Site are in US dollars and do not include applicable Texas sales tax, shipping, or third-party fees unless otherwise stated. We reserve the right to correct pricing errors.

Accepted payment methods

  • Credit and debit cards (Visa, Mastercard, American Express, Discover)

  • In-store cash payments

  • Cryptocurrency: Bitcoin (BTC) on the Bitcoin network, and Ethereum/USDC on the Base network. See our Crypto Payments & Tips page for details.

Cryptocurrency-specific terms

  • Cryptocurrency transactions are final once confirmed on the blockchain and cannot be reversed by ascubadiving.

  • You are solely responsible for sending the correct cryptocurrency on the correct network to the correct address. Funds sent to the wrong address or on the wrong network cannot be recovered.

  • The cryptocurrency amount due is calculated at the time of payment based on then-current exchange rates. Significant price fluctuations between quote and payment may require recalculation.

  • You are responsible for any tax obligations related to cryptocurrency payments under applicable law.

 

5. Course Enrollment

Prerequisites

PADI courses have prerequisites set by PADI standards (age, prior certification level, medical clearance, swim skills, etc.). You are responsible for meeting prerequisites before enrollment. We may reschedule, refund, or refuse instruction if prerequisites are not met.

Required forms

All students must complete:

  • PADI Medical Statement (signed; physician clearance required if any conditions indicated)

  • PADI Liability Release and Assumption of Risk

  • ascubadiving enrollment forms

Students who do not complete required forms cannot participate in instruction. No refunds for incomplete paperwork.

Online learning (eLearning)

PADI eLearning purchases are non-refundable once activated, per PADI policy.

 

6. Trip Bookings

Hosted trips

Some trips are hosted directly by ascubadiving. Others are hosted by partners (including Ocean First and other operators). For partner-hosted trips, the operator’s terms, cancellation policies, and refund policies apply. We will provide those terms before you book.

Deposits

Trip deposits secure your spot and may be non-refundable depending on trip and operator terms. Cancellation timing affects refund eligibility.

Travel insurance

We strongly recommend trip cancellation/interruption insurance and dive accident insurance (DAN) for all bookings. We are not responsible for losses that travel insurance would have covered.

Passports and documentation

You are responsible for obtaining valid passports, visas, vaccinations, and other required documents. We are not responsible for missed trips due to documentation issues.

 

7. Equipment Service

Service partner

We outsource equipment repair and annual service to Airtech Scuba Services (airtechscubaservices.com). Service is performed by certified Airtech technicians. We coordinate drop-off, shipping, and pickup, or you may ship directly to Airtech.

Turnaround

Normal turnaround is 2–3 weeks. Expedited service is available at additional cost. We do not guarantee specific completion dates.

Equipment pickup policy

You must pick up your equipment within 30 days of receiving completion notification.

ascubadiving is not responsible for equipment left at the store for more than 30 days after the completion of repair or air-fill service. Equipment left beyond 30 days may be subject to storage fees or treated as abandoned property at our discretion.

Service warranty

Equipment service is warranted by Airtech per their service terms. We pass through any applicable warranty but are not the warranting party for service work.

 

8. Air Fills

To receive an air fill at ascubadiving, you must:

  • Provide proof of dive certification (certification card or on file with us)

  • Sign our air fill waiver

  • Provide a tank with a current visual inspection (VIP)

We reserve the right to refuse air fills for tanks that are out of test, visibly damaged, or otherwise unsuitable for safe filling.

We do not offer Nitrox fills at this location.

 

9. Equipment Sales

New equipment

New equipment carries the manufacturer’s warranty. Warranty service is provided through the manufacturer or authorized service centers.

 Special orders and personalized items

Special-order equipment and items personalized at your request (custom fit, engraving, etc.) are non-refundable except in case of defect.

 

10. User Accounts

If you create an account on the Site, you are responsible for:

  • Maintaining the confidentiality of your password

  • All activity occurring under your account

  • Notifying us immediately of any unauthorized use

We may suspend or terminate accounts for violation of these Terms.

 

11. Assumption of Risk

SCUBA DIVING AND RELATED ACTIVITIES INVOLVE INHERENT RISKS, INCLUDING SERIOUS INJURY OR DEATH.

Risks include but are not limited to: drowning, decompression sickness, arterial gas embolism, barotrauma, equipment failure, hypothermia, hyperthermia, marine life injury, boat travel hazards, and travel-related risks.

By participating in any scuba course, dive, trip, or related activity organized by or through ascubadiving, you acknowledge that:

  • You have read, understood, and signed the required PADI Liability Release and Assumption of Risk

  • You voluntarily assume all risks inherent to scuba diving

  • You are responsible for your own health, fitness, and ability to safely participate

  • You will follow all instructions from instructors, dive masters, and other staff

  • You will adhere to safe diving practices including dive table or computer limits

 

12. Site Use

You agree not to:

  • Use the Site for any illegal purpose

  • Attempt to gain unauthorized access to the Site or our systems

  • Interfere with the operation of the Site

  • Scrape, harvest, or systematically copy content from the Site

  • Use the Site to transmit malicious code or spam

  • Impersonate any person or entity

We may suspend Site access for any violation.

 

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • The Site and our services are provided “AS IS” without warranties of any kind, express or implied, except as expressly stated.

  • ascubadiving, its owners, officers, employees, instructors, and contractors are NOT liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, our services, courses, trips, equipment, or related activities.

  • Our total liability for any claim arising from your use of the Site or services shall not exceed the amount you paid to ascubadiving for the specific product or service giving rise to the claim.

  • Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, or any liability that cannot be limited by law.

 

14. Indemnification

You agree to indemnify, defend, and hold harmless ascubadiving, its owners, employees, instructors, contractors, partners (including Airtech, Ocean First, and trip operators), and PADI from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of:

  • Your use of the Site or our services

  • Your violation of these Terms

  • Your violation of any law or third-party rights

  • Your participation in any scuba course, dive, or trip

  • Your provision of false, inaccurate, or incomplete information

 

15. Intellectual Property

All content on the Site (logos, text, photos, videos, layout) is owned by ascubadiving or its licensors and is protected by US and international copyright and trademark law. The PADI trademark and PADI course materials are owned by PADI.

You may not copy, modify, distribute, or use Site content without our written permission, except for personal, non-commercial use as a customer.

 

16. Third-Party Services

The Site links to and integrates with third-party services (PADI, Ocean First, DAN, Airtech, Google, payment processors, and others). We are not responsible for the content, accuracy, or practices of third parties. Use of third-party services is at your own risk and subject to their respective terms.

 

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date. Continued use of the Site or our services after changes constitutes acceptance.

Material changes affecting active orders, course enrollments, or trip bookings will be communicated to affected customers directly.

 

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

Any dispute arising from these Terms or our services shall be resolved in the state or federal courts located in Tarrant County, Texas, and you consent to the jurisdiction of those courts.

 

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

 

20. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and any signed PADI Liability Release or other paperwork, constitute the entire agreement between you and ascubadiving regarding your use of the Site and our services.
